Terms of Service

Draft — pending legal review. This document reflects how DevClimate is built today and is accurate as a technical description, but it has not been reviewed by counsel and is not yet a binding agreement. It must be reviewed before DevClimate is offered outside DevCanopy.
Agreement
These terms govern use of DevClimate, operated by DevCanopy LLC. By creating an organization or signing in, the person doing so accepts these terms on behalf of that organization.
Accounts and roles
An organization's administrator manages its roster and roles. Administrators have full access including organization settings and integrations; managers can create surveys and view results; members respond to surveys and typically never sign in at all. You are responsible for the accuracy of the roster you upload and for having a lawful basis to process the contact details in it.
Acceptable use
You agree not to:
- Attempt to re-identify individual survey respondents, whether by technical means, by correlating results against roster data, or by structuring teams so that a team's aggregate describes one person.
- Use DevClimate to survey people who have not been informed that they are being surveyed.
- Probe, scan, or attempt to breach the service, or access another organization's data.
- Resell or white-label the service without a written agreement.
The first item is not boilerplate. Deliberately configuring the product to defeat its anonymity guarantee — including setting an anonymity threshold that makes a team's results attributable to a single person — is grounds for termination.
Your data
Your organization owns the data it puts into DevClimate. We process it to operate the service and for no other purpose. See the Privacy Policy for the specifics, particularly the separation between roster data and survey responses.
Availability
We aim to keep DevClimate available but do not guarantee uninterrupted service. Scheduled survey delivery, reminders, and cycle auto-close run as background jobs; delivery timing is best-effort rather than guaranteed to the minute.
Termination
You may close your organization at any time. We may suspend or terminate an account that breaches these terms, and will give notice where it is practical to do so.
Liability
DevClimate is provided as-is. To the extent permitted by law, DevCanopy LLC is not liable for indirect or consequential loss arising from use of the service.
